Terms of Service

Card Wallet ("Card Wallet," "we," "us") is a digital wallet for physical trading-card collections: you photograph your cards, confirm what they are, and track estimated market values. These Terms of Service ("Terms") govern your use of the Card Wallet website, applications, and services (together, the "Service"). By creating an account, starting a guest vault, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You may start as a guest without registering; a guest vault is tied to your device and browser. You can claim a vault by adding an email address, which lets you access your collection from other devices. You are responsible for maintaining access to your email account and for all activity under your Card Wallet account. You must provide accurate information and may not impersonate anyone else. You must be at least 13 years old to use the Service.

Guest vaults that are never claimed with an email address may be deleted after extended inactivity; we cannot recover a guest vault if you clear your browser data or lose the device.

The free plan includes manual collection management and a limited number of card scans. Paid plans unlock unlimited scanning and estimated values: an Annual subscription that renews automatically each year at the then-current price until canceled, and a Lifetime plan, a one-time payment granting access for the operating life of the Service. "Lifetime" refers to the lifetime of the Service, not of the purchaser. Payments are processed by Stripe; we do not store your card number. Prices exclude any applicable taxes.

All purchases are final and non-refundable, except where a refund is required by applicable law. The Service provides immediate access to paid market data that costs us money to obtain the moment you use it; your payment covers that access. You may cancel an Annual subscription at any time via the customer portal - cancellation stops future renewals and your access continues through the period already paid. Purchasing constitutes your acknowledgment and acceptance of this no-refund policy.

We may change pricing for new purchases and renewals at any time; renewal price changes take effect at your next renewal, and we will provide notice as required by law. If a payment is refunded, reversed, or charged back for any reason, the associated access ends immediately.

Estimated values shown in the Service are derived from recent completed sales and other market data for the card, condition, and grade you confirm. They are estimates only. They are not appraisals, not offers to buy, not guarantees of resale value, and not financial, investment, or insurance advice. Market data may be incomplete, delayed, or wrong; where data is thin we say so, and where there are no recent comparable sales we show none. You are solely responsible for any decision you make based on information from the Service.

Card scanning uses automated text extraction and machine-vision services to suggest what a card is. Suggestions can be wrong; you confirm every card before it is saved, and the accuracy of your collection records is your responsibility. Scan photos you submit are processed by our recognition providers solely to identify your cards (see the Privacy Policy).

You keep ownership of the photos you upload and the collection data you enter. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to operate, secure, and improve the Service - including sending scan photos to our recognition providers to identify your cards. This license ends when you delete the content or your account, except for copies retained in routine backups for a limited period.

You represent and warrant that, for everything you upload or submit: (a) it is your own original photograph of an item in your possession, or you otherwise hold all rights necessary to upload and use it; (b) it does not infringe or violate the intellectual-property, privacy, publicity, or other rights of any person; and (c) it is not unlawful, fraudulent, or misleading. You must not upload images copied from the internet, screenshots of other people's photos or listings, or any image you did not create or do not have the right to use. You - not Card Wallet - are solely responsible for your content and for its accuracy and legality.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Card Wallet and its owners, operators, employees, and service providers from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content you upload, submit, share, or export through the Service; (b) your violation of these Terms; (c) your violation of any law or of any third party's rights, including intellectual-property, privacy, or publicity rights; or (d) your misuse of the Service. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with us in asserting any available defenses.

We respect intellectual-property rights and expect our users to do the same. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at copyright@getcardwallet.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim was infringed; (c) identification of the material claimed to be infringing and enough detail to locate it on the Service; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will remove or disable material we determine to be infringing and, in appropriate circumstances, terminate the accounts of repeat infringers. If you believe your content was removed in error, you may send a counter-notice to the same address.

You agree not to: upload images you do not own or have the right to use; misrepresent the identity, condition, grade, or authenticity of any item; circumvent scan limits, entitlement checks, or other technical controls; scrape, harvest, resell, or redistribute pricing or market data from the Service; access another user's data; reverse engineer the Service; use the Service for any unlawful, infringing, or fraudulent purpose; or interfere with its operation. We may suspend or terminate accounts that violate these Terms, with no refund, except where required by law.

The Service - its software, design, and content other than your content - is owned by us and protected by law. Trading-card names, set names, player names, team marks, and grading-company names are the property of their respective owners. Card Wallet is not affiliated with, endorsed by, or sponsored by any card manufacturer, league, players' association, or grading company.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

You may stop using the Service at any time and may request account deletion (see the Privacy Policy). We may suspend or terminate the Service or your access for violation of these Terms, legal requirements, or discontinuation of the Service. If we permanently discontinue the Service, Lifetime and Annual access end with it; we will make reasonable efforts to provide advance notice and a way to export your collection data. Sections that by their nature should survive termination - including content warranties, indemnification, disclaimers, and limitation of liability - survive.

We may update these Terms; material changes will be posted here with a new "Last updated" date, and continued use after changes take effect constitutes acceptance. These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law rules, and disputes will be resolved in the state or federal courts located in Massachusetts.
